Conduct

The Purpose of these by-laws is to explain the mission, goals and organizational structure of the Michigan Delta 5 Militia.

1. MISSION

To support the Delta 5 militia.

To defend the Constitution of the State of Michigan and the Constitution of the United States of America. To uphold and to defend the Bill of Rights, seen as unalienable, and given by our creator to free men that they may remain free.

To support the people of the county. To insure that all citizens-- regardless of race, color, religion, sex, physical characteristics, or national origin-- shall have the right and opportunity to due process of the law as established and guaranteed by the Great Document which guides this Great Nation.

2. GOALS

It will be the goals of the Delta 5 militia to:

a) PRESENT itself to the citizens of this region as a well-regulated, well-trained, well-equipped, and knowledgeable militia unit consisting of ordinary citizens rather than professionals.

b) ASSIST citizens in the event of national disaster, civil defense, and in the defense of self and state.

c) ESTABLISH a cohesive command structure able to instruct and task as needs arise.

d) TRAIN its membership in many disciplines necessary to the function of the militia as a whole, and as members individually.

e ENCOURAGE its members to stand against all tyranny which threatens to undermine our form of government and these United States of America.

f) UPHOLD the pure constitutional rule of law whereby all citizens have the right to trial by a jury of their peers in a court of law.

g) SEEK the wisdom and for all and, in doing so, protect the liberty and freedom for all people.

3. ORGANIZATIONAL STRUCTURE (tentative)

A Range Safety Officer (RSO) will be determined and will have authority concerning firearms at all times. Although, any member becoming aware of situations they deem unsafe shall have the authority to stop or prevent it.

4. MEMBERSHIP

Membership in the Delta 5 militia shall be open to any citizen over the age of 18 regardless of sex, race, religion, physical characteristic or national origin. Membership is voluntary, and will last until the member withdraws or is dismissed by proper authority.

All militia members will be required to provide basic information about his/her self or CPL information for background check.

4.1 Types of Membership

a) Active Member-- An active participant in the Delta 5 militia activity requirements, abiding by the rules and regulations of the Delta 5 militia, having completed the 90-day probationary period, qualifying in Rifleman Level 1 or higher and providing information required will receive voting privileges.

b) Absentee Member-- An active participant in the Delta 5 militia through communication and activities (when able), abiding by the rules and regulations of the Delta 5 militia, having completed the 90-day probationary period, qualifying in Rifleman Level 1 and providing information required will receive voting privileges but can abstain from voting with regard to unfamiliarity of situation. This category will be enacted for active members who, in situations beyond there control, leave the Michigan area.

c) Active Support Member—An active participant in the Delta 5 militia activity requirements, abiding by the rules and regulations of the Delta 5 militia, having completed the 90-day probationary period and providing information required will receive voting privileges. No Rifleman Level necessary.

d) Inactive Member/Inactive Support Member-- A member no longer participating in the Delta 5 militia activity requirements. Inactive member or supporters may have the opportunity to reactivate their status and do not retain voting privileges.

e) Youth Member—A member up to the age of 17.

4.2 Withdraw/Dismissal

A member may voluntarily withdraw his or her membership in the Delta 5 militia at any time by notifying their intentions in writing or by e-mail or other written communication. Following the 90-day probationary period, a decision to dismiss a member or members from the Delta 5 Militia must have the approval of 100% of the active / voting membership, excepting those members with conflicting interests. A member or members dismissed or withdrawing  from the Delta 5 militia ***(will return all tags and patches containing the Delta 5 emblem)***.

4.3 Conduct

Militia members are highly encouraged to live exemplary lives as outlined in the Michigan Militia Code of Conduct and the laws of the State of Michigan.

CODE OF CONDUCT

I am an American serving with the unorganized civilian militia, which guards my family, my homeland, our Constitution and our way of life. I am prepared to give my all in their defense.

I will never surrender of my own free will, if in command, I will never surrender the members of my command while the have the means and will to resist.

If I am captured I will continue to resist by all means possible. I will make every effort to escape and aid others to escape. I will accept neither parole nor special favors from the enemy.

If I become a prisoner of war, I will keep faith with my fellow prisoners. I will give no information or take part in any action that might be harmful to my comrades. If I am senior, I will take command. If not, I will obey the lawful orders of those appointed over me and will support them in every way.

When questioned, should I become a prisoner of war, I am bound to give only my name, rank and date of birth. I will evade answering further questions to the utmost of my ability. I will make no oral or written statements disloyal to my beloved homeland and its citizens or harmful to their continued struggle for liberty and freedom as prescribed in the Constitution of the United States .

In all cases, I will endeavor to instruct and to inform members of organized militia units seeking to persuade them to join the Patriot struggle, urging them for justice and conscience sake to return America to the Constitutional Republic our forefathers envisioned.

I will never forget that I am an American, a citizen of the greatest nation on earth, fighting for freedom, responsible for my actions, and dedicated to the principles which made my country free.

4.4 Recruitment

Under no circumstances are militia members to discredit the Michigan Delta 5 militia by pressuring citizens to join or to contribute material or financial support. All material and financial contributions and/or donations will be accepted with the clear understanding that the inalienable rights of all will be protected without qualification.

5. OATH OF THE MILITIA MEMBER

All militia members will be required to take the oath and sign it, to uphold the Constitution of the United States and the Constitution of the state of Michigan and to protect it from all enemies.

5.1 Oath for Members

"I, (Name), do solemnly swear that I will support and defend the Constitution of the United States and the Constitution of the state of Michigan against all enemies, both foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the lawful orders of those appointed over me, for conscience sake; So Help Me God.

6. UNIFORMS AND EQUIPMENT

As a member of the Delta 5 militia, you will be required to procure and maintain items of uniform and equipment. When in uniform, you represent the Delta 5militia. Therefore your uniform will be clean and in good service (rips sewn, all buttons) and patches sewn on properly. Proper impression is very important to the public. Civilian clothing will be worn in public areas or public functions unless specified.

The primary uniform of a Delta 5 member will be the woodland pattern BDU. Secondary uniform patterns may consist of FOREIGN uniforms that are similar in shade and pattern to the woodland pattern or seasonal camouflage colors and/or patterns. Current military configurations are NOT acceptable as militia uniforms.

The primary weapon of a Delta 5 member will be the rifle. It will be required of all militia members, not otherwise opposed for conscience sake, to have their own rifle, ammunition, and knapsack.

Militia members are required to remain proficient in the maintenance and safe operation of the rifle and to have a minimum of 200 rounds of ammunition and 75 rounds per sidearm available at all times. The militia member's knapsack shall consist of necessary items to be determined, based on the member's assignment. Thus outfitted, the knapsack will be kept available at all times for rapid deployment by the militia member. If you are restricted to limited funds, set your priority on proper uniforms and attire rather than exotic military hardware.

Militia members WILL be expected to obey all Constitutional state and local firearms laws. Militia members are normally expected to carry military style firearms. Only in self-defense will a militia member discharge his weapon. As with members of organized military units within Michigan, militia members are expected to abide by all hunting rules and regulations pertaining to the use of firearms for that purpose.

7. COMMUNICATION

In the case of a natural or man-made disaster, the role of communication is critical. Therefore, the Citizen band radio and FRS radio’s will be the principal forms of communication for the Delta 5 militia. Persons taking part in emergency communications should have a valid ham radio operator license.

8. TRAINING AND MEETINGS

Periodic musters and assemblies are necessary and shall be called to achieve the overall goals of the militia unit. Members must discipline themselves to set aside time each month, for assembly. Militia members will be notified of actual assembly times and places. While it is intended that the militia intrude as little as possible in the private lives of its members, it is also clear that individual members are volunteers and must be ready to meet periodically and to deploy as the need arises. It will be the objective to infringe as little as possible on the time of militia members, recognizing their responsibilities to their families and jobs.

8.1 Quarterly requirements

Active duty members will be required to come to two training/meetings per quarter and two weekenders (overnight) field training per year. Extenuating circumstances may be excused.

8.2 Other groups

Our bylaws are to be followed in training with other groups. If training exercises or actions go against our bylaws, are dangerous or a safety hazard, Delta 5 will remove itself and no other training will be done with that group, til the conflict has been resolved..
